Coalition sues EPA over new WOTUS rule
A coalition of 18 farm and industry groups sue the EPA over the new Waters of the United States rule.

The American Farm Bureau filed the lawsuit against the EPA Wednesday in the Southern District of Texas. Seventeen others including the National Cattlemen’s Beef Association, National Corn Growers and the National Pork Producers were joined by the petroleum industry, home builders and realtors in the suit.
The coalition wants the rule struck down because they believe it adopts an unworkable definition of WOTUS that conflicts with the Clean Water Act, the Constitution, and Supreme Court precedent. The suit claims previous exclusions were nullified in the final rule.
Barring an injunction or immediate legal remedy to stop its adoption, the new rule will take effect on March 20, 2023.
